Why Canada can’t strip Elon Musk of Canadian citizenship


An online petition that asks the Canadian government to revoke the citizenship of Elon Musk is on the way to becoming one of the most popular in the history of the House of Commons.

There is only one problem: Canada cannot revoke the citizenship of Musk.

Immigration lawyer Gabriela Ramo says that according to the Canadian law, someone’s citizenship can only be revoked if it can be demonstrated that they committed fraud or misrepresentation to obtain it.

“Before they could move to do this, they would have to introduce legislation, there should be amendments to the current law of citizenship,” said Ramo, former president of the Immigration Section of the Canada Lawyers Association. “There is no disposition that allows them to follow the revocation of the citizenship of a Canadian birth, by virtue of their birth to a Canadian mother.”

Ramo said it is “quite rare” for Canadian citizenship to be revoked.

Rémi Larivière, an immigration media relations officer, refugees and citizenship of Canada, said the government does not take the revocation of citizens lightly.

“The citizenship of a person can revoke whether the person obtained, retained, renounced or resumed his citizenship by false representation or fraud or if he hid the material circumstances knowingly,” Larivière said.

He said the process includes several steps and a decision of a Federal Court judge unless the citizen in question asks the immigration minister to make the decision.

The citizenship of Musk has been at the center of attention in recent days after the author of British Columbia, Qualia Reed, launched the petition last week asking the Canadian government to revoke the citizenship of Musk and her Canadian passport, given the role he is playing in the government of the president of the United States, Donald Trump.

“Elon Musk has been involved in activities that go against the national interest of Canada,” says the petition sponsored by the new Democratic deputy Charlie Angus. “He has used his wealth and power to influence our elections; he has now become a member of a foreign government that tries to erase Canadian sovereignty; and Elon Musk’s attempts to attack Canadian sovereignty must be addressed.”

The petition has raised more than 263,000 signatures since it was published on February 20. The province with most of the firms, more than 96,000, is Ontario, followed by more than 53,000 British Columbia, more than 43,000 Quebec and more than 25,000 Alberta.

Those who sign an electronic house of the house must provide their email address, full name, postal code and telephone number. Canadian citizens living outside Canada are eligible to sign requests as well, said Olivier Duhaime, spokesman for the House of Commons.
