Lucknow: A 22 -year -old man, accused of raping a three -year -old girl when he was 17 and judged him as an adult in a Lucknow’s court since 2019 he was sentenced to 20 years in jail and fined RS 1 Lakh later If they are convicted this week, reports Pathikrit Chakraborty.
The legal authorization for the then suspicious teenager to be tried as an adult was based on a medical test that supposedly confirmed that he had “the mental maturity” of someone over 18 years old “while committing the crime and understood its consequences.”
The Court of the Additional District Judge VIJENDRA Tripathi delivered the sentence under sections 376 AB of the CPI (violating a woman under 12 years old) and 6 (aggravated penetrating sexual assault) of the postco law, 2012. The convict would need to spend three additional additional months in jail if he could not deposit the fine. The money will go to the survivor.
DCP (West) Vishwaet Srivastava said the case was registered on May 6, 2019 by the Kakori Police, based on a complaint from the survivor’s grandmother. The author, a neighbor, assaulted the girl at home. “A stagnant case was prepared, and the load sheet was presented on July 5, 2019,” said Srivastava.
Lucknow District Government Lawyer (criminal) Broj Tripathi told Toi that the youth justice law, 2015, created the classification of crimes to allow courts to prove minors in age group 16-18 as adults for crimes “atrocious.”
“In this case, the Court tried to violate the child under three years as an atrocious crime.
In compliance with the directive of CM Yogi Adityanath, we followed the case to ensure that the defendant obtained the maximum.
