Nueva Delhi: The Supreme Court rejected on Friday a statement that challenged the decision of the Superior Court of Delhi to confer senior designations to 70 lawyers, stating that no defender receives a preferential treatment based on his dress.
A Bank of Judges Br Gavai and K Vinod Chandran dismissed the request presented by the lawyer Mathews J Nedumpara and others, arguing that the classification of lawyers in high defenders and others violated constitutional equality.
“We do not see that anyone receives a better deal in this court simply because it has a different dress,” the bank observed.
During the hearing, Nedumpara raised concerns about delays in listed cases, particularly bail requests, in the Superior Court of Bombay. Judge Gavai responded by noticing that judges often work late to administer outstanding cases. “The judges are also human beings … They are trying to do their best,” he said.
When Nedumpara suggested to appoint more judges for faster justice, the bank commented: “It is not in our hands to appoint more judges.”
When addressing the claims that lawyers feared the Court, the bank refuted the notion: “No one is afraid … lawyers are not afraid. Lawyers have led the movement of freedom of this country.”
The petition had challenged sections 16 and 23 (5) of the Defenders Lawarguing that the classification of lawyers in two categories granted “favors and privileges” to a few selected.
In a previous hearing, the Apex court had criticized “runoff and unfounded accusations” against the judges in the plea.
