Nueva Delhi: The Supreme Court withdrew the Government of Uttar Pradesh on Monday for demolishing houses in Prayagraj within 24 hours after notification, saying that he had “shocked the conscience of the court” and hinted that would allow the devastated owners to rebuild their homes subject to the result of the case that challenges the demolition. The case refers to the drag of the houses of a lawyer, a teacher and others in 2021.
A Bank of Judges Abhay Oka and N Kotishwar Singh, based on the affirmation of the aggrieved, was excepted the way in which the demolition was carried out and called the high hand of the State. “The Court’s awareness releases the way in which within 24 hours after the notice it was made,” he said.
However, the UP government played the version of the petitioners that the demolition team had moved in a day after notices were given.
The attorney general R Venkataramani, who appeared for the State, argued that petitioners were reasonable to respond to the notice. He said that on December 8, 2020, they were given the first notice, followed by notices in January 2021 and March 2021. The petitioners said that the demolition warning was issued on March 1, 2021, delivered on March 6, 2021, and the demolition was carried out on March 7.

The petitioners said that they were not given a reasonable opportunity to challenge the demolition notice before the Appeals Authority under Section 27 (2) of the UP Urban Development Law and Development Law.
“The State must act very fairly and the State must give reasonable time to allow them to present an appeal before the structures are demolished. Notice delivered on March 6 and the demolition carried out on March 7. Now, we will allow you to rebuild,” the bank said.
The bank indicated that the notices were attended by the statement, which is not the method approved by law and only the last notice was delivered through the legally recognized method.
“Therefore, we will approve the order only in light of these facts. The way in which the entire process has been carried out … The court cannot tolerate said process. If we tolerate in one case, it will continue. We will pass an order that they can rebuild at their own cost and if the appeal fails, then they will have to demolish at their own cost,” he said.
The court asked the petitioners to submit a company and postpon the case. The petitioners in the case are the lawyer of Zulfiqar Haider, Professor Ali Ahmed and three other individuals. They moved the Apex court after the Superior Court of Allahabad dismissed its plea against demolition.
