As the Constitutional Bank of the Supreme Court resumed the requests for review of the hearing in the case of the reserved seats, Judge Salahuddin Panhwar was challenged from the bank after an objection of the main lawyer Hamid Khan.
In his brief welcome order of July 12, 2024, eight of 13 judges ruled that 39 of an 80 -mna list were and are the returned candidates of the PTI, which establishes it to emerge as the largest party in the National Assembly.
However, the ruling had not been implemented by the National Assembly, while the Pakistan Electoral Commission (ECP) had raised some objections. Review requests against order SC had been presented by the PML-N, the PPP and the ECP.
An 11 members headed by Judge Aminuddin Khan resumed the hearing today.
Judge Panhwar said that Hamid Khan, lawyer of the Sunita Ittehad (sic) Council, had raised an objection to the bank yesterday.
“Hamid Khan raised an objection to the inclusion of judges in the bank that went to the Supreme Court after amendment 26 at the bank,” Judge Panhwar said, and pointed out that he is one of the judges included in the objection.
“Public trust in the Judiciary is essential,” said Panhwar.
“It is essential that no part have any objection to the bank,” he said. “It is because of these objections that I cannot sit in this bank.”
The judge told Khan that, although he was injured by his comments, having worked together since 2010, this was not a personal matter.
Khan said he appreciated Panhwar’s decision.
However, Judge Aminuddin Khan told him that this was not an issue for EB appreciated. “This is the result of his behavior,” he said.
“We respect you, that’s why we are listening to you, otherwise we didn’t have the obligation to listen to you,” Judge Khan said. “We gave you this opportunity, don’t do it wrong.”
After the challenge of Judge Panhwar, the SIC lawyer also opposed a bank of 10 Memas of 10 Memb that assumed the hearing.
To this, Judge Commandkhail questioned under what law the lawyer was doing this argument.
Judge Commandkhail added that the Bank of 10 members will continue to listen to cases.
“Giving respect is what gives you respect,” he told Khan. “Any respect that has today is due to the Supreme Court.”
“Today we are here, tomorrow we will not be here, you will not be here,” Judge Commandkhail said.
SIC’s lawyer told Judge Commandkhail not to use the case if it was angry.
Judge Aminuddin intervened here, asking the SIC council what objection he had.
“My objection is that a bank of twelve members cannot hear the review of the decision of a Bank of thirteen members,” Khan said.
Judge Aminuddin rejected this objection and asked him to proceed with his arguments.
Here, the debate between Khan and the judges warmed.
“SIC’s lawyer had given his arguments, he had no right to speak,” Judge Commandkhail said. “We gave you respect.”
