Less than a week ago, a Guatemalan woman who gave birth to an American baby of less than a week along with her newborn while facing deportation, US officials said.
A spokesman for the National Security Department said Sunday that the woman was arrested by customs agents and border patrol and hospitalized after she illegally crossed the border between the United States and Mexico while she had eight months pregnant.
She gave birth at the Hospital “under supervision,” said the spokesman. It was discharged by medical staff and transferred to the custody of the application of immigration and customs while waiting for an appointment in court, the spokesman added.
A CBP spokesman said in a separate statement on Saturday that the woman “illegally crossed the United States from Mexico among the entrance ports near the three acorns ranch” in Arizona last week.
The location is located in the Federal Land north of the border between the United States and Mexico along a desolate section of the Sonora desert about 72 miles south-southwest of Tucson.
After hospitalization, the CBP spokesman said that the “processing” was completed and the unidentified mother received a notice to appear before an immigration judge. At the end of the processing, said the spokesman, he was given the opportunity to contact a lawyer.
“This morning, women’s custody was transferred to ICE application and removal operations with a date in court to appear before an immigration judge,” said CBP spokesman on Saturday. “The child remains with the mother.”
A woman’s lawyer, Luis Campos, told the NBC Affiliate Kvoa de Tucson on Friday that his client gave birth on Wednesday and that they had denied access to her during her time under hospital care at the Tucson Medical Center.
A spokesman for the medical center did not immediately respond to a comment request on Sunday.
Reuters reported on Saturday that the mother “avoided fast -track deportation after the intervention of” the governor of Arizona, Katie Hobbs, a Democrat, who according to the publication had intervened.
“While Governor Hobbs supports to ensure the border, she has been clear in her opposition to the inhuman practices of immigration application,” Hobbs spokeswoman Liliana Soto, said Friday about X. “The governor will continue to fight to protect the constitutional rights of each Arizonan and maintain our safe communities.”
The Hobbs press office did not immediately respond to a more information request on Sunday.
The CBP spokesman said on Saturday that the mother had no right to legal representation until the processing was completed and had an appointment in court.
The spokesman’s statement mentioned that the woman has a child, but did not mention that she had just given birth in custody. He described it as “eight months of pregnancy” when she was arrested north of the border.
“He was immediately given the opportunity to contact a lawyer” after processing and establishing a notice to appear, said the spokesman. “At all times, the agents followed the law and adhered to the CBP procedures. Rights were not denied.”
The DHS spokesman’s statement on Sunday confirmed that the woman had crossed the United States with an “unborn child.” He characterized her for being “rescued” by CBP agents.
Both DHS and CBP said the child has stayed with her.
Campos said that she believes that the woman will be deported and that her son will be removed with her, despite the state of the newborn as a natural American citizen. “The boy will probably go with her,” he told Kvoa.
He said he hopes to request asylum for women because he feared for his life in Guatemala.
Experts have said that growing violence in Mexico along its border with Guatemala, where it is known that Guatemalans work in seasonal works in agriculture, along with the lack of work opportunities in their homeland, have inspired tens of thousands of Guatemalans to walk north to the United States.

Three other American citizen children from two families were withdrawn from the country with their mothers at the end of April under what representatives and critics have characterized as a rapid deportation that aims to avoid their right to due process, an accusation of federal border agencies have denied.
