Legislators in at least nine states have introduced measures to try to avoid the right of same -sex couples to marry.
Five of the measures, including one introduced on Tuesday in Michigan, urge the Supreme Court to cancel its 2015 historical funds in Obergefell v. Hodges, which gave same -sex couples throughout the country the right to marry.
State representative Josh Schriver, a republican chosen in November 2022, presented the marriage resolution in Michigan, saying in a state principles on which the country was established.
“The increase in cases of religious persecution has been a consequence of the court ruling 10 years ago,” Schriver said in the statement. He cited as examples of the announcement of the State Attorney 2019 that the adoption agencies financed by the State could no longer legally reject LGBTQ couples due to their religious beliefs and a wedding place for Grand Rapids that faced fines and harassment in 2022 after it would not organize weddings for same -sex weddings.
“The new resolution urges the preservation of the holiness of marriage and the constitutional protections that ensure freedom of conscience for all Michigan residents,” Schriver said.
Schriver did not immediately respond to an additional comments request.
A group of 12 Republican legislators supports the resolution, according to Detroit’s NBCIV affiliate.
Similar measures that explicitly seek to reverse Obergefell’s decision have been introduced in Idaho, Montana, North Dakota and South Dakota. The Idaho Chamber approved its resolution last month by a vote of 46-24, and the North Dakota Chamber approved its measure on Monday 52-40.
Legislators in at least four additional states: Missouri, Oklahoma, Tennessee and Texas, introduced bills that do not refer to Obergefell, but which, if signed, would create a category for the marriage called “pact marriage” that would only be For a man and a woman.
Naomi Goldberg, executive director of the movement’s progress project, a group of LGBTQ experts, told NBC News in a statement that such attempts to undermine the rights of marriage between people of the same sex, in case they leave the legislatures, would face A long list of obstacles.
“Research shows that most Americans continue to support the ability of same -sex couples to marry. And two years ago, a bipartisan Congress approved the law of respect for marriage, which repealed the Federal Marriage Defense Law, codified the federal recognition of marriage and, most importantly, it also requires that the States recognize the legal marriages of other other states, ”said Goldberg. “Despite these resolutions and attempts to undermine the recognition of marriage, Obergefell remains the law of the land.”
A ‘ridiculous distraction’
Some Michigan Democrats have already criticized Schriver’s measure. In a press conference on Tuesday, state representative Jason Morgan, one of the state -elect’s elected officials of the State, described it as a “ridiculous distraction that does not help a single family of Michigan.”
“With Donald Trump leading the Republican Party, the threats to our rights are more real than they have been,” said Morgan, who represents Ann Arbor, who chose Kathy Kozachenko, the country’s first openly gay official in the country, in 1974.
Morgan added: “Michigan will not go back. … love is something worth fighting, and we will never stop fighting for what is correct. “
Curtis Hertel, president of the Michigan Democratic Party, said on social networks that the measure, which he called “deeply dangerous”, “is not a surprise from Josh Schriver” and the Republican Caucus.
“Schriver is attacking hundreds of thousands of Michiganders who are beloved members of the community, and does not deserve to serve the people of Michigan,” said Hertel.
Schriver has faced criticism in the past for the opinions he shared on social networks.
In December, he wrote in X: “Make homosexual marriage illegal again. This is not remotely controversial, or extreme. “
