New Delhi: el Allahabad HC Bar Association He has strongly opposed the decision of the Supreme Court to transfer Judge Yashwant Varma From the Superior Court of Delhi to the Superior Court of Allahabad, in the midst of recovering a substantial amount of cash of its official residence after a fire incident on March 14.
After a general meeting of the house in Prayagraj on Monday, Anil Tiwari, president of the Allahabad HC Bar Association, condemned the move and demanded more actions. “We have approved 11 proposals. First, we will not tolerate its transfer (Justice Yashwant Varma) here under any circumstance; it did not happen today, nor should it happen in the future,” he said.
In addition, he urged CJI to allow investigating agencies to take action. “We ask the President of the Supreme Court of India to allow the CBI and ED to present a FIR against him and make a trial, as is done for any political or bureaucratic leader, since the incident is not part of any judicial function.”
Tiwari also requested political trial procedures against Judge Varma. “We have asked the Government to initiate the political trial process, which should proceed as soon as possible to avoid any attempt to destroy evidence. We have also questioned the appointment system, stating that it is unfair. The collegiate system only provides opportunities for well -connected people.”
The Supreme Court College, led by CJI Sanjiv Khanna together with four more senior judges, issued a resolution that recommended the transfer of the judge Varma to its parent court, the Superior Court of Allahabad.
The Collegium reviewed the transfer proposal on March 20. The Superior Court has clarified that the transfer is not related to internal investigation initiated by the president of the Superior Court of Delhi regarding cash recovery.
‘I spend the right direction’: Dhankhar praises CJI
Rajya Sabha president Jagdeep Dhankhar praised CJI Khanna for defending judicial transparency in the middle of the ongoing controversy.
Dhankhar mentioned that, for the first time since Independence, a president of the Supreme Court has publicly revealed all the relevant material without retaining any information.
“This is a step in the right direction. The formation of a committee by the President of the Supreme Court and its surveillance are also notable. Institutions such as the Judiciary and the Legislature work better when its internal mechanisms are efficient, rapid and defend public confidence,” he added.
‘It is not a garbage container
This is not the first time that the Allahabad HC Bar Association has opposed the transfer. Last week, he wrote to the president of the Supreme Court Arun Bhansali, stating that Allahabad HC is “not a garbage container.” The association linked the decision with broader concerns about the judicial appointment and transfer system, arguing that the public faith had weakened in the rule of law.
Judge Yashwant Varma, in his response to the investigation panel, has denied any irregularity, qualifying the accusations an attempt to malignant him. In a letter to the President of the Supreme Court of Delhi HC, he declared that neither he nor his family had any connection with the cash allegedly discovered on the site.
