A teenager who declared himself guilty of involuntary homicide in a deadly group attack against a homeless man in Toronto was sentenced to 15 months of probation, and the judge took into account the time he has already spent in custody and the searches of “illegal” strips he suffered.
The girl underwent a surprise plea in February while she and another teenager were being tried for second degree murder for the death of Kenneth Lee, 59.
The adolescent was 16 at the time of the incident, which took place in a center of Toronto Parkette in December 2022 and allegedly involved eight girls.
The fatal swarm was captured in security video, and the footage served as central evidence in the trial.
The judge sentenced the girl on Friday after the crown and the defense jointly agreed the sentence during the presentations earlier this month, recognizing the 288 days that the girl had already passed in custody and six Strips searches that was forced to submit.
The Police had arrested eight girls between the ages of 13 and 16 in the case and accused them of second degree murder, but seven of them declared guilty of minor charges.
Five have declared themselves guilty of involuntary homicide, one to assault and another to assault with a weapon and an assault that causes bodily damage.
A girl awaits a verdict at the end of this month after concluding a judge trial. She tried to declare himself guilty of involuntary homicide, but her plea was rejected by the crown.
