The privacy commissioner Philippe Dufresne is looking for a federal court order that orders the Pornhub website to comply with the Canadian Privacy Law.
The application of Dufresne occurs a year after it ended Aylo, the firm based in Montreal behind Pornhub and other pornographic sites, violated the law by allowing intimate images to be shared without direct knowledge or consent.
Aylo’s commissioner’s investigation, previously known as Mindgeek, followed a woman’s complaint whose ex -boyfriend had uploaded an intimate video and other images of her to Aylo’s websites without her permission.
Dufresne concluded that inadequate privacy protection measures in Pornhub and other Aylo sites had led to devastating consequences for the plaintiff and other victims.
He made several recommendations to make him comply with the Federal Privacy Law of the Private Sector, the Law for the Protection of Personal Information and Electronic Documents.
At that time, the commissioner said that the company “expressly disagreed with our conclusions” and had not committed to implement any of the recommendations.
In a press release on Monday, the commissioner’s office said that Aylo changed some of its privacy practices and consent verification mechanisms during and after the investigation.
Dufresne maintains, however, that the company’s practices still fail to guarantee a significant consent of all who appear in their videos.
“Privacy is a fundamental right and people must be protected,” he said in the press release.
