A well educated wife with experience in adequate paid work cannot remain inactive only to claim her husband’s maintenance, ORISSA HC has observed, reducing the amount of maintenance ordered by a family court in a Divorce case From RS 8,000 to RS 5,000 per month.
“The law never appreciates those wives who remain inactive only to dirty the husband with the responsibility of paying maintenance by not working or not trying to work despite having adequate and high grades,” said Judge Gourishankar SataPathy. “The intention and objective of the legislature by promulgating section 125 of CRPC was to provide relief to wives that cannot be maintained and do not have enough income for their livelihood,” he added.
