Why is Rustad considered “incapacitated”?

For those wondering why the British Columbia Conservative Party has used the phrase “professionally incapacitated” to describe Rustad upon his release, it is likely due to the wording of the party’s bylaws, where it says: “The leader may only be removed from office by resignation, death, incapacitation or leadership review vote resulting in less than fifty percent (50%) support of party members in good standing voting on a universal secret ballot.”
Rustad is alive, has refused to resign, and recently won a leadership review with 71 percent support.
So the only way to remove it is through “incapacitation”. The party’s board is basically arguing that the fact that the majority of the committee and board are against him makes him professionally “unfit,” but if Rustad disagrees, it might be up to the lawyers to argue what exactly that word means.
