The Pakistan Electoral Commission (ECP) notified on Monday the disqualification of three PTI legislators on their sentences in several cases, according to the documents available with Dawn.com.
Last week, an anti -terrorism court in Lahore acquitted the leader of PTI Shah Mahmood Qureshi while sentenced Dr. Yasmin Rashid, Senator Ejaz Chaudhry and others to 10 years in prison during a case of May 9 disturbances related to violence in the Sherpao bridge.
According to notifications, Chaudhry, member of the National Assembly (MNA) Mohammad Ahmed Chatta and member of the Provincial Assembly (MPA) of Punjab Ahmad Khan were disqualified under article 63 (1) (h) of the Constitution (a person will be disqualified of being chosen [if] … has been, for condemning for any crime that involves moral turbitude, sitting in prison for a period of no less than two years).
The first notification recognized Chaudhry’s conviction in the case ‘The State against Dr. Yasmin Rashid, etc.’, reading: “As a consequence, Senator Ejaz Ahmad Chaudhry has become disqualified by virtue of article 63 (1) (h) of the Constitution of the Islamic Republic of Pakistan for being a member of a member of [the] Senate.
“As a result, notification No. F.3 (2)/2021-Cord. Dated March 10, 2021 to the point of Ejaz Ahmad Chaudhary, as a senator, retires with an immediate effect,” added the notice, referring to the document that notifies Chaudhry’s seat.
The second notice also recognized the 10 -year sentences of Chatta and Khan on July 22, but in the case ‘The State against Zafarullah Khan and others’.
“As a consequence, Mohammad Ahmed Chattha, MNA of NA-66 Wazirabad and Ahmad Khan, MPA, Punjab Provincial Assembly of PP-87 Mianwali-Bill have been disqualified in article 63 (1) (h) of the Constitution … to be members of the National and Provincial Assembly Assembly of Punjab, respectively, the notification of the ECP.”
“Result, notification No. F.2 (5)/2024-Cord (1) dated February 16, 2024 in the Mohammad Ahmed Chattha degree and notification No. F.2 (6)/2024-Cord of February 17, 2024 to the point of Ahmad Khan as returned candidates, they are remembered with the immediate effect.”
Earlier this month, the president of the Punjab Assembly, Malik Muhammad Ahmed Khan, presented a reference to the ECP against 26 PTI legislators on the ‘non -parliamentary conduct’ during the session of the Assembly on June 27.
The disqualification reference moved against the same legislators who were suspended for interrupting the speech of Prime Minister Maryam Nawaz and causing chaos in the house.
However, the speaker formally rejected the requests after successful negotiations between the government and the opposition.
In 2023, the founder and former PTI prime minister, Imran Khan, was disqualified for five years after his conviction in the case of Toshakhana.
In a notification, the ECP cited a court order and declared that Imran disqualified under article 63 (1) (h) of the Constitution read with section 232 of the 2017 Elections Law.
