In the hotel room with McLeod

Humphrey is now going through the consensual sex that McLeod and Em had in the hotel room when they arrived.
She agreed with the lawyer’s suggestion that began oral sex before having sex.
Humphrey reads a portion of a 2022 statement issued EM in which he said that sex with McLeod was not “forced”, but felt that he was not “present at the time.” Em now agrees on that statement.
Humphrey: “Are you saying you had no consent? [to that sex]? ”
EM: “No, I’m not saying that I am not giving his consent. I was fine with what he was doing. In terms of not being an active participant. He was not doing it in my own enjoyment. I was not doing it for myself. I was just going to go through the movements to satisfy it.”
Humphrey: “Do you agree that you were not too drunk to consent to sexual relations with McLeod?”
Em “I would not have made that decision if I was sober, but I made that decision.”
The defense questions the initial sex with MCLEOD as part of its general line of questions about poisoning and consent.
The charges against McLeod and his teammates are related to the alleged sexual aggressions later at night with several men in the room.
