Atmore, wing. – A Alabama man who launched his appeals and said he deserved to die for the rape and murder of a woman in 2010 was executed on Thursday night.
James Osgood, 55, was declared dead at 6:35 pm CT after a lethal injection in a prison in southern Alabama, authorities said.
A jury in 2014 condemned Osgood of Capital Murder for the death of Tracy Lynn Brown in Chilton County. The prosecutors said that Osgood cut off his throat after he and his girlfriend sexually assaulted her.
Osgood recently told Associated Press that he had retired his appeals last year, he added: “I am guilty of murder.” In a letter to his lawyer who explains his decision to find an execution date as soon as possible, he wrote that he was tired and no longer felt he was “even existing.”
“I firmly believe in, as I said in court, an eye for one eye, a tooth for a tooth. I gave myself a life, so mine was lost. I don’t believe in sitting here and wasting everyone’s time and everyone’s money,” Osgood told AP.
Brown, 44, was found dead at home on October 23, 2010, after his employer worried when he did not appear at work.
The prosecutors said that Osgood admitted to the police that he and his girlfriend assaulted Brown, forcing her to perform sexual acts, after discussing how they had fantasies about kidnapping and torture someone. Then he cut his throat. His girlfriend, who was Brown’s cousin, was sentenced to life imprisonment.
The jury found Osgood guilty after about 40 minutes of deliberation and unanimously recommended the death sentence.
Osgood last week he said he wanted to apologize to Brown’s family, but he didn’t expect his relatives to forgive him. “I’m sorry to have removed her. I regret to shorten her life,” he said.
His initial death sentence was expelled by a ruling from the Court of Appeals that jurors received inappropriate instructions. In his resentment in 2018, Osgood asked to be executed, saying that he did not want families to support another audience.
When delivering the death penalty in the ressentation, the judge pointed out that Osgood had a difficult childhood that included sexual abuse, abandonment and an attempt of suicide. But the judge also said that it was Osgood who cut Brown’s neck and stabbed her as she begged the couple not to hurt her.
The execution was the second in Alabama this year and 14 in the nation in general.
