The stay occurred after Yediyurappa challenged the decision of the Court of First Instance of having knowledge of the case.
The main lawyer CV Nages, who represents Yediyurappa, argued that the complaint was questionable, noting that the plaintiff and his daughter had met the Bengaluru police commissioner several times after the alleged incident without making any accusation. He also noted that the key witnesses that were present at the Yediyurappa residence during the alleged incident had confirmed that nothing adhesive had happened.
Nagesh also argued that the Court of First Instance had approved its order without thoroughly considering the facts of the case.
However, the general lawyer Shashi Kiran Shetty, who represents the State, opposed the petition, arguing that the Court of First Instance had found sufficient reasons to proceed with the case. He said that remaining in the order would negatively affect the case of the Prosecutor’s Office.
The decision of the Court of First Instance of taking a new knowledge followed an order of February 7 of the Superior Court, which had instructed the Court of First Instance to reconsider and approve the appropriate orders on the final report of the CID in the case.
