Immigration and Foreigners Bill, 2025, tabled in Lok Sabha, opposition says it violates constitutional provisions

Rejecting the suggestions that Parliament lacked legislative competence to present the bill, Minister of State for Household Nityanand Rai, said the central government has all rights under the list of the Union to provide legislation on the subject. He said that while tourists were welcome to India, it was the government’s responsibility to ensure that the peace and sovereignty of the nation remained intact.
Oppose the bill at the introduction stage, the deputy of the Congress Manish Tewari, while opposing the bill, said he violated multiple provisions of the Constitution and several laws. He said that the bill violates the principle of fundamental rights and the government can use the provisions of the proposed law to deny entry to those who are not synchronized with the ideology of the dominant dispensation of the day.
The veteran deputy of the Trinamool Congress, Saugata Roy, said that the proposed law could avoid talent from abroad in several fields.
In his comments before formally presenting the bill, RAI said the bill seeks to correct the overlapping and duplicate provisions in the prevailing laws that govern immigration and foreigners in the country. The legislation aims to rationalize several services related to immigration and foreigners, including their entry, exit and stay in India. The entrance, departure and stay in India is currently governed by the Law of Registration of Foreigners, 1939 and the Law of Foreigners, 1946.
The stay and the movement of foreigners in India and their departure are regulated by the governments of BOI and state and the administrations of territory of the Union. According to existing laws, foreigners in students, students, doctors, research, employment, missionaries and long -term projects (more than 180 days) must be registered in the Regional Regional Official of Regional Registry (FRRO) or Registration of foreigners The officer (of) worried, with jurisdiction over the place where the foreigner intends to stay, within 14 days after arrival.
